How Family-Based Immigration Works
Under family-based immigration, non-citizens are able to obtain an immigration visa or green card through family sponsorship (also known as filing a petition).
- A U.S. citizen can sponsor, or file an immigrant visa petition for their husband or wife, son or daughter, parent, and brother or sister.
- A U.S. lawful, permanent resident (green-card holder), however, can only sponsor or file an immigrant visa petition for their husband or wife, and unmarried son or daughter.
What Are the Two Types of Family-Based Immigrant Visas?
There are a number of family-based immigration visas available for you, but the type of visa you will need is based on your situation and your relationship with your U.S. citizen family member.
The two main types of family-based immigrant visas are:
